SCOTUS Ruling in Tyler v. Hennepin County, Minnesota, Et Al:
A recent ruling by the US Supreme Court (“SCOTUS”) has important implications for private property rights nationwide. In Tyler v. Hennepin County, SCOTUS ruled in favor of a private property owner in Minnesota whose property was seized by the government and sold for unpaid taxes. The County sold the seized property for more than the amount of tax debt and tried to keep the extra funds as “excess.” SCOTUS ruled this violated the Fifth Amendment of the US Constitution, which authorizes the government’s use of eminent domain and the taking of private property for just compensation. Meaning, the County government owed the property owner the excess funds.
