Estate Planning:

Planning for your potential disability or incapacity is not what you necessarily think of as “estate planning.”  But, designating a trusted family member or friend to manage your assets and aid in your healthcare decisions is a critical component of a good estate plan. Disability planning documents, like medical and financial powers of attorney, are powerful tools for directing your care and the preservation of assets if you lose mental capacity. We are including a thoughtful article about determining who can be your medical agent and how to have those important conversations about your care if you lose mental capacity. The second article explains the tools we use at Braun & Gresham to help you protect your legacy with strong disability planning.

Conservation:

On August 11, the Hays County Commissioners Court at its regular meeting approved the addition of a November ballot measure to approve a $75 million bond that would be used to protect open space, preserve natural resources, and create new parks. Hays County landowners could significantly benefit from this measure, if passed.  The County has stated the purpose of Prop 8 is to “protect and conserve the county’s unique natural landscapes, provide flood mitigation and storm water management, protect water quality and improve endangered species habitats.”  The approval of this ballot measure supports the idea that land set aside for conservation is valuable and will continue to trend.  Braun & Gresham tracks potential sources of funding such as these for purposes of monetizing our client’s highly valuable development rights.
